License and Terms
These terms are an agreement between you and Falls City Labs about Thumbtile (the "Software") and this website. By installing or using the Software you agree to them. If you do not agree, do not install or use it.
1. License
- Free version and trial. You may use the free version and the 14-day trial on any number of your own computers.
- Pro license. A Pro purchase gives you a personal, non-exclusive, non-transferable license to use Thumbtile Pro on up to three computers that you own or control. It is a one-time purchase for the version you buy, including updates we release for it.
- Businesses may buy one license per person who uses the Software.
2. What you may not do
- Sell, rent, share or publish license keys, or let others use your license beyond the device limit.
- Remove or bypass license checks, or reverse engineer the Software except where the law allows it despite this restriction.
- Redistribute the Software or modified copies of it.
3. Purchases and refunds
Orders are processed by Polar (polar.sh), our reseller and merchant of record, which also handles taxes. Refunds are covered by our refund policy. If a payment is refunded or charged back, the license for it ends.
4. Ownership
The Software is licensed, not sold. Falls City Labs keeps all rights not expressly granted to you. Logitech, Logi and MX Master are trademarks of Logitech Europe S.A. and/or its affiliates; Thumbtile is not affiliated with or endorsed by Logitech.
5. No warranty
The Software is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise it will be error free or work with every mouse, monitor or app.
6. Limitation of liability
To the fullest extent the law allows, Falls City Labs is not liable for any indirect, incidental, special or consequential damages, or lost data or profits, arising from the Software or this website. Our total liability for any claim is limited to the amount you paid for the Software.
7. Ending the license
This license ends automatically if you break these terms. When it ends you must stop using Thumbtile Pro and delete your license key.
8. Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict of law rules. Nothing here limits rights you have under the consumer laws of your own country.
9. Changes
We may update these terms. The version in effect when you buy applies to that purchase.
